VAT Refund Services: Regain Your Company's Financial Strength

For exporters taking their business to international markets, companies carrying out transactions subject to reduced rates and large-scale investors, Value Added Tax (VAT) receivables are among the most critical balance sheet items affecting the company's cash flow. Offered to bring these funds, which can legally be claimed from the state, quickly back into working capital, VAT refund services, are the key to financial sustainability. Within the complex and constantly changing structure of Turkish tax legislation, managing the refund process completely, quickly and in full compliance with the law requires expertise. At Akal CPA, with our strong operational experience at Ankara’s bureaucratic center, we analyze your company's VAT receivables from the state on a zero-error principle and ensure that they return to your company's coffers as cash or by offset in the shortest possible time.

Transactions Giving Rise to VAT Refunds and the Legal Framework

Under the VAT Law, VAT amounts that businesses have incurred but could not collect through their sales can be reclaimed from the Ministry of Finance within the scope of certain exemption and deduction provisions. The main commercial transactions that give rise to a company’s VAT refund right are as follows:

  • Export Exemption: Exports of goods and services, and deliveries with export registration (VAT Law Article 11).
  • Transactions Subject to Reduced Rates: Transactions such as textiles, food and construction that are delivered at a 1% or 10% VAT rate but whose raw materials are purchased with 20% VAT (VAT Law Article 29).
  • Transactions with an Investment Incentive Certificate: Machinery and equipment purchases made on the basis of the Ministry of Industry and Technology’s approved incentive certificates (VAT Law Article 13).
  • International Transportation: Transit transportation and logistics operations to foreign countries, or from foreign countries into Türkiye’s territory (VAT Law Article 14).

Identifying these transactions in company records and maximizing refund amounts requires a proactive tax consulting and planning strategy. Our expert team protects your company from bureaucratic obstacles by structuring the refund process before the invoice is even issued.

Operational Processes Within the Scope of VAT Refund Services

The smooth completion of a VAT refund requires a meticulous operation, from sub-firm analyses (Counter Examination) to uploading the lists to the Revenue Administration (GİB) system. Akal CPA takes over the statutory records your business keeps as part of its general accounting services and carries out the following steps in full:

  • Preparation of the Incurred VAT and Deductible VAT Lists: All invoices included in the cost of the product or service subject to the refund are identified one by one and converted into electronic lists in GİB format.
  • Analysis of Customs Exit Declarations (GÇB): For export transactions, the completion (border exit) dates are checked to verify the periods in which the export legally took place.
  • KDVİRA (VAT Refund Risk Analysis) Check: Error and deficiency reports (KDVİRA) generated by the GİB system are analyzed immediately by our experts; risks of fake documents or documents misleading in content (SMİYB) originating from sub-firms are eliminated, and the necessary explanations are promptly submitted to the tax office.

Comparison of Cash Refund and Refund by Offset

Businesses can claim their VAT receivables from the state in two ways: in cash (payment to the company's bank account) or by offset (applied against the company's other tax/SGK debts to the state). You can review in the table below which method suits your company's financial strategy:

Criteria / Feature VAT Refund by Offset Cash VAT Refund
Basic Mechanism The amount is deducted from the company's debts to the state (Corporate Income Tax, withholding tax return, SGK premiums, etc.). The refund amount is paid into the company's commercial bank account in cash as a direct deposit.
Bureaucratic Speed Much faster and more practical. It is generally approved without requiring a tax inspection. Requires a longer and more detailed review process. The tax office applies the process strictly.
YMM Report Requirement A YMM (Sworn Financial Advisor) report is not required for offset requests below certain limits. Regardless of the amount (except for certain exceptional limits), a YMM VAT Refund Certification Report or a Letter of Guarantee is mandatory.
Letter of Guarantee Requirement For refunds by offset, submitting a bank letter of guarantee is generally not necessary. Before the YMM report is issued or the tax inspection is completed, to receive the refund in advance, a Letter of Guarantee is required (except for holders of an İTUS certificate).

YMM Certification Report and the Assurance of Tax Audit

For large VAT refunds, the safest way for businesses to recover their cash without being examined by tax inspectors is to manage the process with the assurance of a Sworn Financial Advisor (YMM). Akal CPA reviews your company's refund files in line with tax inspection and full certification standards. The YMM VAT Refund Certification Report prepared secures the accuracy of your company's documents vis-à-vis the state. Counter-examinations along the sub-firm supply chain are completed quickly by our expert auditors, ensuring that the refund reaches your bank accounts without getting stuck on bureaucratic obstacles.

Ankara-Based Operational Strength for Foreign-Capital Companies

Especially for foreign investors newly entering the Turkish market or starting their activities with company formation for foreigners operations, VAT may appear to be a significant cost item. However, the millions of liras of VAT incurred during factory set-ups, large construction projects or technology investments can be fully recovered with the right incentive certificates and refund strategies. At Akal CPA, thanks to our geographic and sectoral proximity to Ankara’s public institutions such as the Revenue Administration, the Specialized Tax Offices and the Ministry of Treasury and Finance, we conclude your refund processes at the source, as quickly as possible and in full compliance with the law. While your business focuses on exports and production, our expert team with a global vision secures the collection of your VAT receivables.

Frequently Asked Questions

It is the sale by manufacturers of the goods they produce, without collecting VAT, to foreign trade capital companies or exporting firms "on condition of export", instead of exporting the goods themselves. The manufacturer is entitled to claim from the tax office, as a refund, the VAT it could not collect on this sale but paid when purchasing its raw materials, at the moment the products clear customs (are exported). This is a significant source of financing support for producers.

For VAT refunds by offset (applied against tax/SGK debts), a YMM report is not required up to a certain monetary limit set each year. However, for offset requests above this limit, and for all cash VAT refund requests regardless of the amount, the Ministry of Finance requires the submission of either a Tax Inspection Report, a Bank Letter of Guarantee or a YMM VAT Refund Certification Report.

No, you cannot. Under tax legislation, the matured (overdue) tax debts and SGK premium debts owed to the state by a company entitled to a VAT refund are first automatically offset (deducted from the debt) by the system. If a VAT refund receivable still remains after these legal debts have been settled, the remaining amount may be paid in cash to the company's bank account.

No, your refund will not be canceled outright. KDVİRA is an artificial intelligence analysis in which the tax office system cross-checks the documents you submit and your sub-suppliers. When the system finds an error or inconsistency, the tax office requests an "explanation" from you. Our expert financial advisors review these errors and either exclude (remove) sub-firms carrying a risk of fake invoices, or respond officially to the tax office with bank receipts and waybills proving the accuracy of the invoices, so that the refund process resumes where it left off.

VAT refunds arising from transactions subject to reduced rates (products sold with 1% or 10% VAT but purchased with 20% VAT) may be requested annually starting from January of the year following the year in which the transaction took place (until the November period return), and may also be requested "by offset" in monthly periods within the relevant year, within the specified legal limits. Cash refunds can generally be made in the following year.
